Sunshine Hawk (the “Service”) is a software-as-a-service product that ingests publicly available Florida government records and presents them in a unified, searchable form. The Service is provided on an as-is basis. By creating an account or paying for a subscription you agree to these terms.
2. Accounts
You are responsible for keeping your password confidential and for all activity that happens under your account. Notify us immediately if you suspect unauthorized access. We may suspend or terminate accounts that abuse the Service, harm other users, or violate these terms.
3. Subscriptions and Payment
Paid plans are billed monthly in advance. All charges are processed by Stripe; we do not store your card number. Your subscription renews automatically until cancelled. You can cancel at any time from the Account page — cancellation takes effect at the end of the current billing period, and your paid features remain available until then. We do not offer prorated refunds for partial months; see our Refund Policy for details.
4. The Data
The records presented by the Service are sourced from Florida state and local government publications. We do our best to ingest them accurately and timely, but we do not warrant completeness or accuracy. Source records can contain errors, be republished, or be revised by the publishing agency. Do not rely on the Service as a sole source for legal, financial, or compliance decisions. Always confirm against the originating government source before acting.
5. Acceptable Use
- Do not redistribute, resell, or sublicense bulk extracts of the data.
- Do not scrape the Service or attempt to circumvent rate limits.
- Do not use the Service to harass, surveil, or otherwise harm any individual.
- Do not attempt to gain unauthorized access to other accounts, our infrastructure, or third-party systems.
6. Intellectual Property
The underlying public records are not owned by us. The Service’s software, UI, aggregation, deduplication, entity-graph join, and AI-generated briefings are owned by Sunshine Hawk. You retain ownership of any data you input (watchlist names, watchlist items, notes).
7. Limitation of Liability
To the maximum extent permitted by law, Sunshine Hawk is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use of the Service. Our total cumulative liability for any claim shall not exceed the amount you paid us in the twelve months preceding the claim.
8. Changes
We may update these terms from time to time. Material changes will be announced via email to your account address at least 7 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
9. Governing Law
These terms are governed by the laws of the State of Florida, USA. Any dispute will be resolved in the state or federal courts located in Pasco County, Florida.
